Terms of service
In effect from
The short version
These terms are the agreement between your business and us when you claim a LocalFound website. You accept them by ticking the box when you claim.
Your site is written by AI from what your business has published online, so read it and correct anything that is wrong. Once you claim it, you are responsible for what it says, including its photos and customer reviews, and you can change or delete it at any time.
Who this agreement is with
LocalFound is a service of DevPro Software Consulting Inc., #200 - 1965 Broad Street, Regina, Saskatchewan S4P 1Y1, Canada ("we", "us"). "You" means the business that claims a site and the person who claims it on the business's behalf. Our privacy policy explains how we handle personal information and forms part of this agreement.
What LocalFound is
We build a website for a local business from information the business has published about itself, host it at an address on localfound.ca, and let the business claim it, edit it by chatting with our editor, and connect or register its own domain name. Some features need a paid plan. We do not sell plans today, but we may grant one to you at no charge, and if we ever start charging, the section on fees below applies.
Editing uses a monthly allowance, shown in the editor, so that the AI behind it stays affordable for everyone. We may change the allowances, and we will show you the current ones in the editor.
Claiming a site
You may claim a site only for a business you own or are authorised to act for, and you must be old enough to make a binding agreement where you live. The information you give us when you claim must be true. If we have reason to think a claim was not made by the business, we may refuse it, suspend the site or undo the claim.
The content is written by AI
We write your site with AI, from what your business has published online. It can be wrong: hours can be out of date, a service can be described inaccurately, and a detail can be invented. Read your site before you share it, and correct anything that is not right. Once you have claimed the site, you are responsible for what it says, just as you would be for a website you wrote yourself.
Nothing on your site, or said by our editor, is legal, financial or professional advice.
Your content
Your content stays yours: the text you write, the photos and logos you upload, and your business's own information. You give us permission to store it, show it on your site, and process it (including with the AI providers named in our privacy policy) for as long as we need to in order to provide LocalFound to you.
You promise that you have the right to use every photograph on your site, that the customer reviews on it are shown as your customers wrote them, and that everything on it is lawful, accurate and not misleading. If the customer who wrote a review asks you to take it down, you will. If someone claims a photo, a review or text on your site infringes their rights, we may remove it while we look into it; our copyright page explains how those reports work.
Whatever rights we have in the text and images we generate for your site, we give to you. Whether AI-written content can be protected by copyright is not settled in Canada, so we cannot promise that anyone else is prevented from copying it.
Messages from your visitors
When a visitor contacts you through your site's form, that information is yours to look after, and you are responsible for handling it lawfully, including answering a visitor who asks to see or erase what they sent. We act only as your service provider: we store it, forward it to you by email, and use it for nothing else. We will tell you promptly if a breach of our safeguards affects it. The notice on your site's form and our privacy policy tell your visitors this.
What you may not do
Do not use LocalFound to publish anything unlawful, deceptive, defamatory, hateful or infringing; to impersonate another business or person; to send spam or collect information from visitors under false pretences; or to attack, overload or get around the limits of our service or anyone else's. We may remove content or suspend a site that does, and we will tell you why unless the law or someone's safety prevents it.
Domain names
If you register a domain name through LocalFound, it is registered through our accredited registrar with your details as the registrant, so it is yours, and the registrar's registration agreement, which you accept when you buy, also applies to it. Registration is set to renew automatically each year. If your plan stops covering the domain, it keeps working for 30 days, we email you before it stops, and then your site goes back to its localfound.ca address.
Fees
Claiming a site, keeping it and editing its content within your allowance are free. We will never charge you anything without first showing you the price and getting your agreement, and we will never charge anyone to remove a preview or to have their information deleted. If we introduce paid plans, their price, renewal and cancellation terms will be shown to you before you buy.
Deleting your site, and ending this agreement
You can delete your site at any time from your settings. It goes offline straight away, you have three days to change your mind, and then the site and its photos are permanently deleted. Our privacy policy explains what we keep after that and how to have it erased. Before you delete, you can ask us for a copy of your site's content at help@localfound.ca.
We may suspend or end your use of LocalFound if you break these terms, if the law requires it, or if we stop offering the service. Unless you have broken these terms, we will give you at least 30 days' notice by email, so that you can take a copy of your content and move your domain.
What we promise, and what we do not
We will provide LocalFound with reasonable care and skill. Beyond that, and as far as the law allows, LocalFound is provided as it is: we do not promise that it will always be available, free of errors, or right for your business, or that it will bring you customers.
Limits on our responsibility
As far as the law allows, we are not responsible for indirect losses, such as lost profits, lost business or lost data, and our total responsibility to you for anything arising from LocalFound is limited to the greater of $100 (Canadian) and the fees you paid us in the 12 months before the event that led to it.
These limits do not apply to our fraud or wilful misconduct, to harm caused by our breach of our privacy obligations, or to anything else the law does not allow us to limit.
Changes to these terms
We may update these terms. We will change the date at the top, and if a change matters to you, we will email you at least 30 days before it takes effect. If you do not agree to a change, you can delete your site before it takes effect.
The law that applies
These terms are governed by the laws of Saskatchewan and the federal laws of Canada that apply there. Either of us may bring a dispute before the courts of Saskatchewan, and nothing in these terms stops you using the courts where you are, or takes away any right the law gives you that cannot be given up by agreement.
